These Terms of Service ("Terms") are a binding agreement between you ("you", "Customer") and
Whisk Green Automator ("we", "us", "Seller"). They govern your use of the Whisk Green Automator browser extension,
its side panel, the website at menumake.net/whisk and every related
service (together, the "Service").
By installing the Service, creating an account, or completing a payment you confirm that you have read,
understood and accepted these Terms and our Refund & Cancellation Policy.
If you do not accept them, do not use the Service and do not purchase anything.
1.Who may use the Service
- You must be at least 18 years old and legally able to enter into a contract.
- You must use the Service only for lawful purposes and only on accounts, content and platforms you are
entitled to use.
- If you use the Service for a business, you confirm you may bind that business to these Terms.
2.The Service, licence and restrictions
The Service is a software tool that helps you prepare and run bulk image-generation prompts inside your own
browser session on third-party platforms. We grant you a personal, limited, non-exclusive, non-transferable,
revocable licence to use the Service for its intended purpose for as long as your account is in good standing.
You may not:
- copy, resell, sublicense, rent, share, publish or distribute the Service or any access to it;
- reverse engineer, decompile, or attempt to extract the source code, except where the law expressly permits it;
- circumvent, disable or interfere with any credit, quota, entitlement, licensing or security mechanism;
- use bots, scripts, automation or multiple accounts to obtain free credits, evade limits, or abuse trials;
- use the Service to break the terms of service of any third-party platform, or to send spam, malware or
unlawful, infringing, hateful or deceptive content;
- use the Service in a way that overloads, disrupts or damages our infrastructure or that of any third party.
We may suspend or terminate your access immediately, without refund, if we reasonably believe you have breached
this section.
3.Third-party platforms and AI models
The Service operates on top of third-party websites, AI models and APIs that we do not own and do not control.
Those services have their own terms, quotas and availability. We are not responsible for their content,
behaviour, pricing, outages, model changes, account actions, or for any decision they take regarding your
account. You are solely responsible for complying with their terms.
Generated output is produced by third-party AI models and may be inaccurate, incomplete, offensive or
unsuitable. You are responsible for reviewing output before you use or publish it, and for holding the rights
needed to use the input images and prompts you submit.
4.Accounts, credits and fair use
- You must provide a valid e-mail address and keep your password confidential. Everything done through your
account is treated as done by you.
- Free accounts receive a limited number of generations. Credits are a usage allowance, have no monetary
value, are not redeemable for cash, are not transferable, and expire as described in the Service.
- Credits, quotas and limits may be adjusted to protect the Service against abuse.
- We may refuse, suspend or close any account, and refuse any order, at our reasonable discretion — for
example in the case of suspected fraud, chargeback abuse, or a breach of these Terms.
5.Prices, payment and renewal
Current plans and prices are shown in the Service and on the plans screen before you pay. As of the effective date:
- Monthly Pro — $3.99 per month (automatically renewing subscription until cancelled)
- Yearly Pro — $14.99 per year (automatically renewing subscription until cancelled)
- Lifetime Pro — $19.99 one-time (one-time payment)
- Payments are processed by Stripe. We never see or store your full card number. Your card
statement shows the descriptor configured on our Stripe account.
- Prices are shown in US dollars (USD). Prices do not include any taxes, duties or bank charges that may apply in your country; those are your responsibility.
- Subscriptions renew automatically. A monthly or yearly plan renews at the end of each
period at the then-current price, and your payment method is charged automatically, until you cancel.
- You may cancel at any time from your account page ("Manage billing") or by
writing to support@menumake.net. Cancellation stops future renewals;
it does not by itself create a right to a refund — see the
Refund & Cancellation Policy.
- We may change prices or plan contents. We will give reasonable notice before a change affects an existing
subscription renewal, and you may cancel before it takes effect.
- If a payment fails we may retry it and may suspend Pro features until the balance is settled.
6.Refunds
Refunds are governed exclusively by our Refund & Cancellation Policy, which forms
part of these Terms. In short: all payments are final and non-refundable, except where a refund
is required by mandatory law or where we expressly decide otherwise in that policy.
Consumers in the EU/UK — right of withdrawal. Where the law gives you a 14-day right of
withdrawal for digital content, you expressly request immediate access to the Service and acknowledge that, by
starting to use it, you lose that right of withdrawal. If you have not yet used the Service and wish to withdraw,
write to
support@menumake.net within 14 days of purchase; that statutory
right is not affected by anything else in these Terms.
7.Availability and changes to the Service
The Service is provided on an "as available" basis. We may add, change, limit or discontinue features, models,
integrations or the Service itself at any time. We do not guarantee uninterrupted or error-free operation,
that any third-party platform will keep working with the Service, or that any particular model, quality level
or export format will remain available.
A "Lifetime" plan means access for the commercial lifetime of the Service — that is, for as long as we continue
to operate and offer it — and not for your own lifetime or the lifetime of any third-party platform. If we
permanently discontinue the Service, we may at our discretion offer a pro-rata credit or equivalent remedy.
8.Intellectual property
The Service, including its code, design, text, trademarks and documentation, is owned by us or our licensors and
is protected by law. These Terms grant you a licence to use it; they do not transfer ownership of anything.
You keep all rights to the images and prompts you submit and to the output you generate, subject to the terms of
the third-party platforms and models involved.
9.Disclaimer of warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without any warranty
of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness
for a particular purpose, title, accuracy, or non-infringement. We do not warrant that the Service will meet
your requirements, produce any particular result, work with any particular third-party platform, or be free of
interruptions, delays, errors or harmful components.
10.Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential,
exemplary or punitive damages, nor for any lost profits, lost revenue, lost data, lost content, lost
opportunities, business interruption, account suspension by a third party, or the cost of substitute services —
even if we were advised of the possibility of such damages.
Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the amount
you actually paid us for the Service in the three (3) months immediately before the event
giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including
liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.
11.Indemnity
You agree to indemnify and hold harmless the Seller, its owner, employees and contractors from any claim, loss,
liability, damage, cost or expense (including reasonable legal fees) arising from your use of the Service, your
content or prompts, your breach of these Terms, or your infringement of the rights of any third party.
12.Suspension and termination
- You may stop using the Service and delete your account at any time.
- We may suspend or terminate your access if you breach these Terms, if we are required to by law or by a
payment provider, or if we discontinue the Service.
- On termination, your licence ends immediately. Sections 6, 8, 9, 10, 11 and 13 survive termination.
- Termination for breach does not entitle you to a refund.
13.Disputes, chargebacks and governing law
- If you have a problem with a charge, contact us first at
support@menumake.net — we will investigate and answer in good faith.
- Filing a chargeback or payment dispute without contacting us first, or filing one that is found to be
unjustified, is a material breach of these Terms and may result in immediate termination of your account.
- These Terms are governed by the laws of the country where the seller is established, without regard to conflict-of-law
rules. The courts of the courts competent for the seller's registered address have exclusive jurisdiction, without prejudice to any
mandatory consumer-protection right you may have to bring proceedings in your country of residence.
- If any provision is held unenforceable, the remaining provisions stay in full force.
- Our failure to enforce a provision is not a waiver of it.
14.Changes to these Terms
We may update these Terms from time to time. The effective date at the top of this page shows the current
version, and material changes will be announced in the Service or by e-mail. Continuing to use the Service
after a change means you accept the updated Terms.
